PRESENTATION

Women drive-Your Private Driver is a transport service, simplified joint stock company with capital of 40000 euro whose head office is at 45 rue boursault 75017 PARIS, France, registered with the Paris Trade and Companies Register under number 81045921400013 (ci -after the « Company »). VAT number: FR34 810 459 214. The Company provides a travel service in a passenger vehicle with driver operating exclusively on reservation, immediate or in advance.

These General Terms and Conditions constitute the contract by which the company offers and provides the Service and apply for orders of vehicles placed by the customer with the company by telephone, by Internet via the site www.womendrive.fr

By using the service, the customer acknowledges and accepts all the terms of these terms and conditions.

1.0 OBJECT OF THE SERVICE

The company provides a transport service and offers its customers chauffeur driven vehicles. It is registered in the register of operators of passenger cars with driver under the number 2015/11/0008206 and subject to the provisions of articles L 231-1 to L231-4 of the Tourism Code and decree n ° 85-891 of 16 August 1985>

2.0 RESERVE A VEHICLE

The customer is informed that all vehicles offered are of a single model (sedan). For the moment, the company is unfortunately not able to offer links with specific vehicles adapted for people with reduced mobility. The service is open every day, 24 hours a day, and is only available by prior arrangement.

2.1 PRIOR CONDITION

The booking of race via the site is subject to the prior acceptance by the customer of these Terms and Conditions.

2.2 STAGES OF RESERVATION

To book, the customer connects to the site by entering his reservation It informs the various fields relating to the desired trip (place of departure, possibly a destination, type of car). In the absence of information from the place of departure, the ordering process can not succeed. In case of seizure of a destination, the company offers a price to achieve the requested route. The customer is free to accept or not the offer proposed by the company; if he accepts it, he must first be sure that all the information displayed is consistent with the desired path. In case of absence of seizure of a place of destination, the booking will not succeed .. The company transmits to the driver in charge of the daily journey the elements of the Order.

2.3 ADVANCE BOOKING

The customer can book a vehicle with the company before the date and time of departure of the race in question. The delay can be from 1 month maximum up to 30 minutes minimum before the scheduled departure time. The customer indicates the date, time and place of departure, the possible intermediate stages and the final point of arrival, the other possible particularities of the race (, additional indication for the place of rendezvous, etc.), as well as than the first and last names of the passenger. Depending on the number of orders already registered at the chosen date and time, the company reserves the right to refuse additional advance orders. The Company registers the order and takes into account the search of the vehicle, without making an immediate reservation of a vehicle at the time of the order. The vehicle search is carried out in the hour before the scheduled departure time, depending on the place of departure, and the traffic conditions.

2.4 RESERVATION AT THE DEPARTURE OF AN AIRPORT

When booking, the customer must specify the airport, the date of the race, and the flight number. The expected landing time and the arrival terminal, which may be modified by the flight conditions and the airport authority, may be specified but are not contractual. The responsibility of the company can not be engaged in case of erroneous information indicated by the Customer (incomplete flight number, date error), or in case of erroneous information relating to the reference flight for the race, transmitted by the Service. 2.5 TELEPHONE BOOKING

Telephone ordering is done 24 hours a day, 7 days a week by calling a « non-premium » number (the cost of a local call from a landline).

2.6 RESERVATION BY THE WEBSITE

The customer can place an order online, via the website www.womendrive.fr The online booking redirects as soon as validation to a secure site Paypal .. No additional charge is levied by the company on the price of the race, in outside the possible additional cost due to the waiting time of the passenger by the driver at the starting point.

2.7 OBLIGATION OF THE CUSTOMER

After validation of the reservation, the customer must report to the agreed place on the day and time scheduled. The customer will receive an email and / or a confirmation message. If waiting for the driver, waiting charges whose amount is determined in section 5, will automatically be billed beyond 8 minutes. In case of no-show, the driver is deemed free to leave after a waiting period of 15 minutes. The customer agrees to behave aboard the vehicle as a good father. In the event of degradation of the equipment or the vehicle attributable to the Customer, the Company will reimburse the cost of repairing the vehicle or changing equipment. Passengers, adults and children, are required to fasten their seatbelt. A fine is incurred by those caught in default during a control by the police. For safety reasons, smoking and transporting flammable, explosive, corrosive or toxic substances is prohibited. Failure to comply with this stipulation is the responsibility of the Customer and the passenger. The Company reserves the possibility of any possible appeal. Baggage must be placed in the trunk of the vehicle. The luggage remains under the full responsibility of the Customer. No luggage can be entrusted to the driver. The driver may refuse baggage whose weight or dimensions are excessive, as well as those he considers harmful to the safety of transport. Any modification of the estimate of the race originally planned and paid in advance through the site (waiting, parking, additional stop, change of address …) will incur additional fees that are billed to the customer directly from the driver.

2.8 OBLIGATIONS OF THE COMPANY

The service offered by the company consists of a search service for an available vehicle corresponding to the customer’s reservation. The company is thus held to a simple obligation of means and implements all its best efforts in order to find a vehicle available for the Customer as soon as possible. Upon receipt of the Customer’s request, in case of seizure of the destination, the company agrees to offer an offer indicating the price of the trip .. If the customer accepts the offer, the company agrees to address him a confirmation of the Order by email and / or sms.

3.0 CANCELLATION OF BOOKING

All cancellation conditions are set out in these Terms and Conditions. If the vehicle has already arrived at the place of departure at the time of cancellation, the race will be totally due to the company. If the customer has not canceled the order before the arrival of the vehicle, that the passenger does not show up at the place of departure where the driver or the company calls the customer on the phone, the full value of the race ordered is invoiced at customer. The customer retains the option to cancel the order 3 hours before the actual start time of the race. In this case the entire amount of the race will be refunded. But in the opposite case he exposes himself to owe the entire amount of the race to the company.

4.0 CONFIDENTIALITY-PROTECTION OF PERSONAL DATA

These General Conditions are subject to the provisions of Law No. 78-17 of 6 January 1978 relating to data, files and freedoms. The customer has a right to access, rectify and delete personal data about him on simple request to the company .. The company informs the customer about the use made of personal data on concerning the collection of the use of the site The company may communicate to third parties the client’s details for the purposes of using the site and in particular to the Driver. The Customer has of course a right of objection (by any means and especially simple mail addressed to the company) to the transfer to third parties for the purposes of commercial prospecting personal information held on his person. The customer agrees that the company reserves the right to record and keep, for the purposes of proof, all information relating to the connections made, such as the data relating to the journeys made and the personal details of the Customer.

5.0 WAITING EXPENSES

The waiting fee is 0.45 € and 0.90 € per minute depending on the vehicle range and will be paid extra with the driver.

6.0 PAYMENT

Payment can be made directly on the site through the secure site Paypal, or directly to the driver by a bank card terminal, or cash.

7.0 ISSUE OF INVOICE

Once the booking paid online, or book directly by phone with the central, the company sends the customer, by email, an invoice directly to the email address he will have communicated when booking.
 

8.0 EXECUTION OF TRANSERT 

8.1 EXTENT OF TRANSFER 

The transfer begins with the customer’s climb in the driver’s vehicle and ends with the customer’s descent from the same vehicle. 

8.2 CUSTOMER SUPPORT 

The driver may refuse to take charge of the customer. If such a refusal results from the behavior of the client (drunkenness, presence of an animal weighing more than 8 kg and not placed in a cage, danger to the safety of the driver and the vehicle, etc.) or incorrect information transmitted by the customer. 

9.0 QUALITY COMMITMENT 

9.1 COMPLIANCE WITH REGULATIONS 

The company is committed to ensuring that drivers and vehicles comply with the regulations in force for the operation of passenger vehicles with drivers. 

9.2 INSURANCE 

The company is guaranteed by a notoriously solvent insurance company that covers the risks related to its activity in accordance with the legislation in force. Passengers are considered as third parties vis-à-vis the driver, and are covered for all bodily, material and immaterial damage that they may suffer as a result of a traffic accident and this in an unlimited way for bodily injury , since the climb in the Vehicle until the descent, except for the damage caused by their fault. 

10.0 PROTEST 

The customer can send by registered letter with request for acknowledgment of receipt (LRAR) a complaint to the company at the following address: 45 rue boursault 75017 PARIS France. Any claim relating to an incident occurring during the race will be forwarded to the Driver, whose company agrees to provide the exact coordinates on request of the Customer. 

If the customer cancel within 24 hours before the start of the reserved period, the total amount of the reservation remains due and can not be refunded. 

10.1: APPLICABLE LAW AND COMPETENT JURISDICTIONS
